The urgency of getting protection from domestic assault or threats is obvious. If there is an immediate and present danger of domestic violence or danger to a child, an emergency protective order will be issued, with immediate effect.
There is a wide variety of Domestic Violence Restraining Orders (DVRO). The emergency order is in effect for only five business days or seven calendar days, whichever is shorter.
If you wish to apply for a further restraining order, you go to court and get a court date, usually within three weeks.
Temporary Restraining Orders (TRO)
If you feel you are in danger at this time, you may apply for a temporary restraining order (TRO). This lasts until your court date/hearing. At the hearing you say why you feel endangered and the “restrained party” gives his or her side of the story.
If a permanent restraining order is issued, it is typically for five years. If there is no specified length on the order itself, it is good for three years. If you wish to extend the order at the end of its validity the court will normally extend it for five years. You do not have to provide evidence of continued danger or fear.
