First, do not speak to the Coast Guard or arresting officer or anyone else regarding this matter until you have spoken to a BUI/DUI lawyer. Consequences for BUI are generally much tougher than DUI because driving on water is deemed more unsafe than on land. Although California law states that those below 21 years of age may not drive with a blood alcohol level of 0.01 you may still have a defense for the fact that you “have not had any drink in hours” prior to being stopped for BUI. Consult with an attorney who is an expert BUI and DUI law for possible defenses and to have an expert represent you.
