Dwayne Wade: From Basketball Court to Family Court

Roseville, CA–The NBA Finals are at a fever pitch and the Miami Heat is the certainly the crowd’s favorite. This season, the three most favorite players are Chris Bosh, James Lebron and Dwayne Wade. But amongst the three, this seems to be Dwayne Wade’s season since all eyes are on him.

dwayne wade from basketball court to family courtPlaying the shooting guard position, Dwayne is reputed to be one of the quickest and hardest to guard amongst the court players but apart from the NBA playoffs where the fights are heating up to get the championship, he is also playing hardball in family court with his ex-wife, Siohvaughn Funches-Wade.

Siohvaughn Funches was Dwayne Wade’s high school sweetheart. They got married and had 2 kids. But gone are the days when people marry their high school sweetheart and both live happily ever after blah, blah, blah. In the case of Dwayne and Siohvaughn, it’s mo’ money mo’ problems.

The problem with marrying a baller is that they are popular and have lots of money which means groupies lining up trying to get a chance to get laid after the game or during team celebrations/parties. In the case of Dwayne, the relationship with his wife deteriorated when their marriage became volatile because of the fights about STDs, child abandonment and adultery.

Dwayne originally filed for divorce in 2007 but the case dragged on and became such a messy divorce. They were finally divorced in 2010 but still had to face each other in family court. Each party was airing their dirty laundry in public.

A few months after his separation (or it may have started even while Wade was still very much married), Dwayne started dating actress, Gabrielle Union. Siohvaughn cried foul and sued Gabrielle Union for “emotional distress” to her and her kids after she claimed that Union and Wade made inappropriate sexual actions in front of the children. But that lawsuit was shot down by the judge stating that they filed in the wrong county. She was suing for $50,000.

Dwayne Wade then petitioned the court to force his ex-spouse to undergo psychiatric evaluation because he believes she has suicidal and homicidal tendencies, he fears for the safety of his children and requested emergency temporary custody of the children.

In 2011, the judge granted sole custody, care and control of the children to Dwayne Wade but granted Siohvaughn parenting time by giving visitation rights to the kids during alternate weekends and some holidays including Mother’s Day.

It was a 102 page resolution and here is part of the excerpt from Judge Renee G. Goldfarb, “This court finds that [Siohvaughn Wade] has embarked on an unstoppable and relentless pattern of conduct for over two years to alienate the children from their father, and lacks either the ability or the willingness to facilitate, let alone encourage, a close and continuing relationship between them…”

In the documents presented to the court, Dwayne Wade stated Siohvaughn has relentlessly used their children as “the proverbial pawns in this contentious dissolution of marriage action.”

But the drama did not stop there, fast forward weekend prior to June 19, 2012; Siohvaughn was arrested for attempted child abduction. By the way, the laws governing parental kidnapping are covered by the Uniform Child Custody Jurisdiction Enforcement Act or UCCJEA.

Siohvaughn has been charged with one count of resisting arrest, two counts of child abduction (parental kidnapping) and two counts of unlawful visitation. And these two have not even finalized the financial aspects of their divorce.

Family law cases are indeed frustrating and emotionally charged and the kids are helplessly dragged into the quagmire. They are the true casualties of a relationship that has gone south and some parents ruthlessly use them to get back to the other parent. For Dwayne Wade and his kids, hope they can finish this ball game in one piece. For now this story still developing …
