Separation Agreement


This Separation Agreement (Agreement) is entered into on ____________ 2012 by and between
______________________ (Husband) and _____________________ (Wife).


1.Both parties were legally married on ___________ in ______________
2. Both parties have made a complete, fair, and accurate disclosure to each other of all financial matters affecting this agreement.
3. Both parties been individually advised and counseled by attorneys of their choosing regarding their legal rights as related to this agreement.

Both parties have now agreed to settle the various issues of their divorce as set forth in this Agreement.

1. Custody and Visitation

There are ____ children from this marriage.

Wife will have physical custody of the children. Husband will have custody of the children during school vacations. Both parties shall share legal custody of the children. Husband shall have the right to visit the children on the weekends.

2. Child Support

The Husband shall pay to the Wife child support of $_______ per child. The payment shall be made on or before the 10th of every month.

3. Alimony

The Husband shall pay to the Wife alimony of $_______ per month. The payment shall be through a deduction from the Husband’s salary.

This Agreement overrides any prior agreement between the parties on the issues. This Agreement can only be modified with the consent of both parties and the consent must be in writing. In case any legal action is required to enforce any term of this Agreement, the prevailing party shall be entitled to attorney fees and court fee from the other party.
