Rights, Privileges, and Duties Inherent in Emancipation

An emancipated minor generally has the same rights and obligations as an adult. The exact specifications of these rights and obligations vary from state to state but generally an emancipated minor can:

• Enter into leases and contracts
• File a lawsuit or be sued in own name
• Purchase or sell real property and other assets
• Prepare a valid will
• Enroll in school
• Inherit property
• Enter into a marriage
• Consent to receiving medical treatment

Subject to state laws, emancipated minors can get a driver’s license and vote in elections.
