Today the developments in medical science offer parents many options to natural conception and pregnancy. Embryo transplantation, in vitro fertilization and artificial insemination are some of the options. However these are certain legal issues associated with such options.
In artificial insemination, the wife with the husband’s consent is artificially inseminated with the sperm of another man (donor) and the wife then conceives the child. In the eyes of law, the child is the legitimate child of the husband. In most states there is a legal presumption that the husband of the woman at the time of the birth is the father of the child.
In vitro Fertilization
In egg transplantation and in vitro fertilization the egg is fertilized outside the womb. Even if the egg is obtained from another woman, the law considers the birth mother as the legitimate mother of the child.
